The International Court of Justice (ICJ) in The Hague has commenced hearings to assess whether Israel is fulfilling its legal obligations to ensure humanitarian aid reaches Palestinians in Gaza and the West Bank. This follows a request by the United Nations General Assembly for an advisory opinion on the matter.
Palestinian representatives and UN officials argue that Israel, as an occupying power, is legally required to facilitate the delivery of humanitarian assistance. They contend that Israel’s actions, including the blockade of aid and the banning of the UN Relief and Works Agency for Palestine Refugees (UNRWA), have exacerbated the humanitarian crisis in Gaza. UN legal counsel Elinor Hammarskjöld emphasized that Israel must allow UN entities to assist civilians, while Palestinian envoy Ammar Hijazi accused Israel of using aid as a weapon of war.
Israel has declined to participate in the oral proceedings, submitting a written statement instead. Israeli officials have criticized the hearings as biased and politically motivated, asserting that their actions are necessary for security reasons, particularly concerning alleged ties between UNRWA and Hamas.
The ICJ’s advisory opinion, while non-binding, carries significant legal and political weight. A final decision is expected in the coming months.
